Justice Charles Daniels seemed sympathetic with recall advocates in his questioning of the lawyers. He asked whether board members who did not comply with public notices about a matter of public importance had opened themselves up to the recall, based on their conduct in office.Daniels also spoke against the court stopping a recall election that the people had petitioned for."You don't think that people in a representative democracy should make that decision at the ballot box?" Daniels said to Kennedy.
